The insurance industry received a harsh reminder from the New Hampshire Insurance Department that if they are charging copays for the required blood lead testing for children between the ages of one and two, they are breaking federal regulations.

In a statement released on Friday, the department stated that it had discovered certain insurers were requiring cost-sharing, though it did not name them.

The Affordable Care Act (ACA) forbids cost-sharing for preventive services, such as lead screening for kids who may be exposed, and such practices “stand in direct contradiction to that provision,” the statement stated.

Initial and follow-up testing required for the preventive screening process cannot be shared in costs. Insurance companies were “strongly encouraged” by the department to examine and adhere to with federal regulations.
