Boulder, Colorado — The city of Boulder has requested that Xcel Energy look into mailers that were delivered by one of its partner companies’ third parties.
HomeServe provides warranty coverage for equipment that may fall under the ownership of the property.
The Colorado Public Utilities Commission (PUC) was requested by the city of Boulder to look into Xcel and HomeServe for “predatory practices.”
According to Carolyn Elam, Boulder’s Sustainability Senior Manager, “We definitely heard from a lot of community members about asking if it was legitimate, expressing their concern about receiving the letter, and wondering if they should sign up or enroll because they were afraid about future outages.”
Customers who questioned the legality of these HomeServe mailers in April spoke with 9NEWS about them.
Boulder raised the PUC’s attention to the HomeServe mailers as part of the PUC’s inquiry into the Public Safety Power Shutoff (PSPS) that occurred in April.
Boulder claimed that following the neighboring wildfires in August, they were mailed again within days of the PSPS in April.

In the PUC filing, Boulder stated, “Boulder would like to take this opportunity to express concern to the Commission about what Boulder considers to be predatory practices by HomeServe USA Repair Management Corporation (“HomeServe”), who purport to have entered into an agreement with Xcel Energy to market insurance coverage for exterior electrical infrastructure to Xcel Energy’s customers, including customers of their Colorado operating company, Public Service.”
“It was really concerning, especially so soon after this proactive power shut-off,” Elam stated. “We are concerned about that, in our opinion—and in my opinion in particular—because I think that’s definitely approaching a fairly aggressive approach.”
The Company is aware that in this process, Boulder has expressed various worries and conjectured about possible commercial practices in relation to mailings from HomeServe USA Repair Management Corporation (“HomeServe”).

The Company takes issue with Boulder’s portrayals. Public Service is aware that HomeServe’s letters to clients after the extreme weather were purely coincidental. Boulder’s claims therefore have no foundation.
Elam stated, “It was very concerning for us when it’s so close on the heels, and twice on the heels of customers in our community experiencing pretty substantially impactful outages.”
“I’m not sure if it was deliberate. It was definitely poor judgment, in my opinion.
Undoubtedly, Elam stated, “our residents must be aware that they are accountable for a portion of the utility infrastructure.”
“If our goal is to instill a sense of empowerment in our clients regarding their accountability, we should urge them to consult their regular home insurance agent or provider to find out what is and isn’t covered so they can make educated decisions.”
A straightforward way to think about responsibility is that the homeowner is in charge of problems from the meter into the house, and Xcel is in charge of the equipment that runs from your home’s meter to the pole.
