“Very sad”: A man from British Columbia had insurance but no license at the time of his 21st driving while intoxicated conviction.

A British Columbian man did not possess a valid driver’s license at the time of his 21st driving while intoxicated conviction. But he did have a car that was insured.
Roy Heide’s blood alcohol content was twice the permitted limit in August 2022. Following an Abbotsford motorcycle crash, he was taken into custody. Heide attempted to leave the scene as his bike passenger was seriously hurt.
Heide entered a guilty plea to driving while intoxicated, driving while disqualified, and driving while forbidden on December 18, 2023.
The fact that this conviction marked Mr. Heide’s 21st conviction for driving while intoxicated is extremely concerning as it is thought to be the highest number of convictions for driving while intoxicated that someone has ever received.
Const. Art Stele, an Abbotsford Police Department spokesman, states that this is “Canadian history.”
Heide was registered as the owner of a motorcycle even though it was illegal for him to drive in British Columbia at the time of his arrest.
According to Stele, “Heide did not have a valid driver’s license at the time of the incident.”
According to court documents, Heide has a long criminal history that dates back to Victoria in the late 1990s. In 1998, he was found guilty of operating a vehicle while intoxicated.
He was found guilty of driving while intoxicated in several Vancouver Island locations during the ensuing years.
Banned from driving but insured?
ICBC states that in order to drive a car, you must have a valid driver’s license, but you are not required to have a current driver’s license in order to get insurance.
According to a representative for the Crown corporation, “obtaining insurance does not require a valid driver’s license because insurance is the responsibility of the registered owner of the vehicle rather than the driver.”
Although they must pay more, people with significant driving convictions can still obtain insurance.
“We often see jail sentences issued when a person has a lengthy criminal history of impaired driving, causes significant injury and/or death as a result of their action,” says Stele.
“The decision whether or not a person faces jail time is independent of police and in the hands of the justice system.”
“All available evidence must be fairly, impartially, and independently evaluated by crown counsel against a two-part test,” the spokesman claims.
Legal representation is required to ascertain whether a prosecution is in the public interest and, if so, whether there is a significant chance of conviction.
“The Crown must prove the accused’s guilt beyond a reasonable doubt in order to secure a conviction.”
For the Abbotsford collision, Heide was given a sentence of four years and three54 days in prison.
Heide was found guilty of driving while intoxicated and causing bodily harm, failing to stop at an accident involving a person, and operating a vehicle while disqualified during an incident that happened in Nanaimo in 2001.
If an individual has had two or more roadside suspensions, one or more 10-point Motor Vehicle Act convictions, one or more driving-related Criminal Code convictions, or one or more other convictions, they are required to pay the driver risk premium (DPR) offered by ICBC convictions for excessive speeding.
“Autoplan insurance premiums are not included in DRP, so drivers who pose a risk are charged regardless of whether they own or insure a car,” the representative explains.
A ‘very sad’ record for British Columbia.
Heide has openly discussed his battles with alcoholism and addiction on social media on multiple occasions.
He asserted that he had changed in September 2020.
The post on Facebook says, “Yes, I’ve been bad, yes I’ve been an alcoholic, yes I’ve probably [harmed] people along the way, but today as alcohol has not played a role in my life for a long time, I am a changed person.”
Heide revealed one month later that “me and alcohol have had a serious divorce and never to have a relationship again” and that he was a component of a 12-step regimen.
According to Steve Sullivan, CEO of MADD Canada, this is a very depressing record for BC.
The best defense society has against this person is if he alters his behavior, so I do hope that treatment is provided as part of any punishment, says Sullivan. “At this point, it is obvious that he needs to be excluded from society in order to stop endangering everyone.”
“The public’s safety must come first, and that means a combination of treatment, a lengthy jail term, and maybe even a long-term supervision order given his past,” Sullivan states. “There also needs to be insurance coverage so that in the event that the driver gets into an accident, the insurance company will pay for it.”
